Compliance is a creative constraint, and constraints are useful
Health brands often run marketing in one of two failure modes: legal reviews everything and nothing ships, or growth ships everything and legal finds out later. Both lose.
The fix is building compliance into the production system so approved creative flows continuously.
Build a claims matrix once, reuse it forever
Sit down with your clinical and legal leads and produce one artifact:
- Claims you can make, with required substantiation and phrasing
- Claims you cannot make, with the compliant alternative
- Mandatory disclosures per product and per market
Every brief, ad, and landing page draws from the matrix. Legal reviews the matrix quarterly instead of every asset — approval cycles drop from weeks to days.
Respect platform rules before they enforce them
Ad platforms restrict personalization and targeting in health categories, and enforcement is getting stricter. Design for it:
- Creative that speaks to the condition category, not the individual's inferred condition
- Landing pages that educate before they qualify
- First-party measurement that doesn't leak health signals into ad pixels
Privacy is part of the brand promise
Marketing data hygiene — what gets sent to pixels, what lives in your CRM, who can access it — belongs in the same review as the creative. Patients notice when a sensitive purchase follows them around the internet, and regulators increasingly do too.
Constrained, trustworthy marketing compounds. Cutting corners converts until the day the account gets shut down.
